Wisconsin Supreme Court justice recuses himself from case

Wisconsin Supreme Court Justice David Prosser has recused himself from an upcoming case, which involves a lawyer who previously represented Justice Prosser in his recount efforts during the last State Supreme Court election earlier this year. Though Prosser said that he would be able to remain impartial on the case, he stepped down after asking the parties involved whether he should participate.

Prosser’s one-sentence recusal letter merely stated that he would be stepping down from this particular cases. Some attorneys are asking how the State Supreme Court will handle future situations similar to this one, but so far no rules are in place, nor was it mentioned in Prosser’s brief letter.
